CANDIDATE DISCLOSURE TEXT ON THE PROTECTION OF YOUR PERSONAL DATA

No: 17/3, 34676 Üsküdar/İstanbul, registered in the trade registry newspaper with the number 280744-5, 0461-0934-4730-0001, Üsküdar Corporate Tax Office, taxpayer number 4610934473, HEETSOFT Information Technologies Inc. as (“Company”); In the capacity of data controller, within the scope of our commercial relations or business relations with you, your personal data will be recorded, stored, preserved, within the scope of the purpose that requires their processing, and in connection with this purpose, in a limited and measured manner, by preserving the accuracy and the most up-to-date version of the personal data you have informed us. We declare that it will be shared with the institutions that are legally authorized to request this personal data, that it can be transferred to domestic or foreign third parties, transferred, classified and processed in other ways listed in the Personal Data Protection Law (hereinafter referred to as “PDPL”);
In all circumstances, your personal data that we have stated below and that you have provided to us; within the scope of our legal relations,
- Within the framework of the purpose that requires their processing and in connection with this purpose, in a limited and measured way,
- By maintaining the accuracy and most up-to-date version of personal data as you have notified us,
- We inform you that it will be recorded, stored, preserved, shared with the institutions that are legally authorized to request this personal data, and under the conditions stipulated by the PDPL, it will be transferred to third parties in the country for the performance of the service, and it can be processed in other ways listed in the PDPL.
The information specified in this Clarification Text and their processing are valid as long as you do not actually terminate your membership or are not subject to ex officio data destruction processes, your personal data that you specified when you registered on the Heetsoft website (the “Company”) or that you specified with the forms provided by our Company. We would like to point out that, apart from making online transactions by registering with the Company, for example, sharing your resume after downloading it or transferring it to third parties via our systems with the “share my resume” function is beyond the control and intervention of our Company.
WHICH PERSONAL DATA DO WE PROCESS?
Our Company, which aims to create employment by bringing our job-seeking members together with our employee-seeking business partner members, also processes your personal data in order to provide better service to all our members for the purposes of realizing these purposes, conducting some research and conducting marketing activities.
The data we can process for the performance of the aforementioned are as follows;
- Identity data; Your name, surname, date and place of birth, gender, marital status, nationality
- Communication data; Your e-mail address, address, mobile phone number
- Special categories of personal data; If you include it in your resume, information about your health or your personal data of special nature recorded in the automatic voice recording system on the support line,
- Training data; Educational status, certificate and diploma information, specialist knowledge, foreign language knowledge, education and skills, seminars and courses attended, computer knowledge, exam knowledge,
- Work experience data; Total experience, employment status and title, work experiences (company names, periods worked, job description)
- Visual and audio data; Photo of a real person, audio recordings if you call our customer service, (Zoom, Webex, Teams, Meet, etc.) visual video, audio, video data if you use the video interview system,
- Website/App usage data; The date you became a member, the applications you made / the level of the position applied for, the frequency / times of your login to the site, the information about you being an ios / android / mobile site / website user, the update date of your resume, the positions you prefer to work in, cities, your registered criteria within the scope of your job messenger membership, companies you have blocked, whether you are working (yes/no), candidate industry name, last login date, last message date, application deleted (yes/no), last message level, last message position, last message industry, last messaged company, last when you use our mobile applications, we process the location data based on your approval, when you use our mobile applications, job level, information about whether the candidate calls the advertisement number on his mobile phone, information about the use of applications (every movement made within the application, IP, Device ID, operator information used, device information (version-model).
- Other; Driver’s license data, competencies, hobby, salary expectation, military service status, reference information (name, surname, title, workplace, telephone, e-mail of the reference person based on the approval we requested from the reference person) and any word, excel, presentation files that you add to your resume, if any. , Profile ID, Login ID, IP address, log records, data contained in the reports generated as a result of the personality inventory made specifically for the individual, questions asked by the employer member to the candidate by Heetsoft during the application for the advertisement (“Standard question”), as well as the questions asked by the customer to the candidate answers to questions (“Private question”),
We will keep your aforementioned data in our systems for five years from the last date you logged into the system with your user name and password, in accordance with the legal regulations to which we are bound due to the performance of our employment agency activity.
In our systems, if you have given your explicit consent, the disability information requested from you during your CV sharing is a special quality personal data since it is health data. We request the aforementioned information from your side in order for the Company to bring groups requiring special circumstances to the labor market. If you do not give your explicit consent, the said data will not be requested from you, and if you do not prefer to share this information, if you need to be employed in the position of a candidate for disability, you have limited the employment mediation service Heetsoft offers to you with your own will, since the employer will not have obtained sufficient information. Similarly, if you have given your explicit consent, we forward the gender question asked to you during your CV sharing within the scope of the Circular on Increasing Female Employment and Ensuring Equal Opportunities. If you do not give your explicit consent, the data in question will not be requested from you. If you do not give your explicit consent, you can create a resume and apply in such a way that this data will not be processed. We state that Heetsoft will not be responsible for any loss of rights that may occur in these cases.
We process your personal data, which you have not been asked during the CV creation, but which you have specified by your own choice, by recording them in your CV. In this context, we recommend that you do not specify any of your personal data on your resume, other than the information in the resume, unless you choose to give permission for PDPL.
In order to assist you in your job search, we also process the information contained in the files you upload using your file upload feature, which we offer as a function. Although you leave the use of this feature to your choice, we recommend that you do not keep your information that you do not want to be processed in these files.
HOW AND FOR WHAT REASONS DO WE COLLECT YOUR PERSONAL DATA?
- To fulfill our legal obligations as a company, to provide us with the personal data we request from you in physical and/or electronic environment, in accordance with the performance of the Service Agreement for the employment intermediary service between us, the performance of the employment contract that can be established between us if you apply to the Company, and the legitimate interest of the Company, We collect information, audio and video input to our company.
- In line with the Company’s legitimate interest in increasing customer satisfaction by providing support to you, we collect audio recordings from our phone calls.
- As required by our Company’s Candidate Pool (“CP”) flow, we collect through audio recordings during the interview with you in order to find the appropriate candidate in the search for personnel that our employer customers we support will want to employ.
- We collect the notes we received in the pre-interviews we made with you within the scope of ”CP”, as you stated.
- Due to the structure of our General Evaluation Tests product, we collect the results of the inventory tests that we send to you and that you solve, upon the instruction of our Employer members.
- We collect the Special questions asked by our employer members to apply for the job and the Standard questions submitted to them by Heetsoft by adding them to your resume.
- We can add the Private questions asked by our employer members to apply for the job posting to your resume, and we collect your answers through Private Questions in a way that only the relevant customer can see.
- We collect your personal data electronically through the cookies used on our website, as detailed in our Cookie Policy, in line with the Company’s legitimate interest in improving the website and making it more effective.
FOR WHAT PURPOSES DO WE PROCESS YOUR PERSONAL DATA?
We process your personal data mentioned above for the following purposes for the performance of the Service Agreement regarding the employment service we provide to you;
- Creating employment and supporting your recruitment process,
- Application evaluation, resume viewing, etc. To provide notifications that can support you in your recruitment process,
- To match with employer customer postings by making use of the personal data you share in order to find you a job and to deliver your employer customers to the right candidate,
- To transfer your CV to the requesting Employer Customer, if you apply or agree to have your CV shared with all employers,
- Answering your calls and responding to your support needs,
- If there is a complaint about the services we provide, to conclude the said complaint,
- To examine your Heetsoft job application in line with your request or in case of complaints on social media,
- Budget management and reporting,
- To increase our service quality and to provide service control,
- To facilitate your access to our mobile applications,
- To be able to intervene in technical problems experienced in the mobile application and to understand the source of the problem,
- In order to provide you with our employment service, to share your personal data, including your personal data of special nature in your resume, with its attachments, with domestic and/or foreign-based employer(s) in line with your sharing preferences,
- In order to provide you with our employment service, we transfer your personal data, including your personal data of special nature in your resume, along with its attachments, to our domestic and/or foreign-based member employers and user accounts of their companies, in line with your sharing preferences. In addition, in line with your sharing preferences, your personal data can be viewed by visitors to our website. In addition, according to your sharing option, natural persons accessing your CV and/or natural person representatives of the legal entity you apply can save your CV in their own data recording systems. The obligation to provide illumination for this transaction is the responsibility of the real and/or legal person institutions/organizations that carry out the transaction.
- When the data you share with the above conditions is processed by the member employer in any way, the member employer customer also becomes the data controller. If you have a request to the employer regarding your data made available to the employer through the company, we will forward your request to the relevant party. In addition, fulfilling the request for the data obtained by our customer about you through our Company; In the capacity of data controller, the employer is the customer’s responsibility. If the member employer wants to use your data, the employer in question may contact you and request your permission.
- Similarly, if you want the normal and/or special quality personal data that we transfer to the employer customer to be deleted, destroyed and/or anonymized, you can send this request to our Company. While we are evaluating your request, we will forward this request to the member employer if we have an ongoing service contract with the member employer. In addition, if our service contract with the member employer has expired, we will get back to you in this regard. Member employers are responsible for the information they obtain through our systems, in this regard, you should send your requests for employer systems directly to the advertiser company, based on your return to you. Our Company has no responsibility or liability in these matters.
We strive to constantly improve and progress in order to fulfill the service we provide to you in the best way possible. For this, we process your personal data as follows;
- Market interpretation, sales, marketing analysis, managerial analysis, financing planning, interpreting the use of the site,
- To increase the quality of the service we provide to you and to ensure quality control,
- Sending bulk e-mails and SMS to help you apply,
- Developing and managing our current and R&D applications, marketing the product,
- Developing the software used in the company by using internal and external resources,
- To support our domestic and foreign employer customers only when necessary,
- To increase service sales for our employer customers, to provide marketing and customer satisfaction analysis,
If you apply to the Company, we process your data for the following purposes in order to evaluate your job application, as it is necessary for the establishment of an employment contract within the framework of the legal relationship between the Company and the candidate employee-employer candidate;
- Recruitment of new personnel, examining the candidates and determining the new candidate to be employed,
- Sharing the notes taken on your resume with the manager so that the manager can better understand and get to know the candidate,
- Confirming the data with the reference people you include in your resume,
- To verify how well you fit with the position and to record your resume information for future confirmation,
Finally, we have an obligation to share your personal data when we are asked to share your personal data through legal requests such as legal and procedural prosecution requests and court decisions, and in accordance with the current legal regulations to which we are subject. In addition, if your personal data is the subject of a dispute in which we are a party, we may need to share your personal data with media and persons such as lawyers, experts, courts, which are necessary for us to exercise our right of defense. We may process your personal data in order to fulfill these legal obligations and to exercise our right of defense.
In order for us to process the personal data (name, surname, telephone, e-mail, etc.) of the reference person(s) you specify in your resume, in order to inform the person in question and to obtain their explicit consent(s). We send an information e-mail to the reference person you specify in your resume. Based on the approval given by the reference person to this e-mail, we ensure that the information of the reference person you specify is added to your resume.
WHERE DO WE TRANSFER YOUR PERSONAL DATA?
We strive to constantly improve and progress in order to fulfill the service we provide to you in the best way possible. For this, we transfer your personal data to third parties in the country and/or abroad as follows:
- We transfer your CV(s) to third parties in line with your sharing preferences.
- If you prefer to be informed about our campaigns and promotions, we transfer your e-mail address and your personal data to the domestic and foreign contracted suppliers providing the relevant service in order to send you a mass e-mail.
- In order to better serve you and our other members and customers, your personal data collected within the framework of the Cookie Policy, the user movement data on the site we collect, we transfer to the parties with whom we have a data controller/data processor relationship to conduct analyzes such as where clicked, how long, etc.
- Our sub-employers and some of our employer members that we receive support from in order to perform our ”CP” service are members of our systems with limited rights and, in line with your preference, process data on behalf of Heetsoft (if you have preferred that all Heetsoft member companies display your CV). Since we are a party, we transfer your data in your resume and other information you have given to us during the interviews we have made with you for this service.
- Similarly, in case our customer using the “CP” service requests a personality inventory from the candidate he/she evaluates for employment purposes, we transfer your necessary data to our supplier, from whom we receive support for the personality inventory process and processes data on behalf of the Company, in order to support the candidate and the employer.
- In the event that our customer, who has benefited from our ”CP” service, requests a personality inventory from the candidate he/she evaluates for employment purposes, we share the data in the report formed because of the personality inventory with our employer member in order to support the candidate and the employer.
- In order to support the employment process of our customers, who do or do not become members of our systems due to the operation of our “CP” service, we share with our customers our interview notes with the candidate suitable for the position determined by them, the information you have provided during these interviews, and your CV registered in our systems.
- Due to our video recording system, when our employer members request a video interview with candidate members, your name, surname, phone number and e-mail addresses are shared with us by the employer member in order to be able to send you a video interview invitation.
- Due to our video recording system, we share your name, surname and e-mail number information with our supplier, from whom we receive technical support, upon the request of our employer members for a video interview with candidate members.
- We use the systems of these suppliers to increase service quality, product development, stay in touch with the companies we work with in our service processes, sales, marketing and reporting activities depending on your communication preferences. During this use, we only transfer your personal data required for the relevant service to the panel provided by this supplier to us.
- In case your application to the Company is evaluated negatively, with your explicit consent, it can be transferred to the affiliated or partner companies with which we work for position evaluations, together with your resume.
- In the event that employers agree with third party suppliers to carry out the recruitment processes (HR firms, consultants, etc.), we transfer your CV together with the CV attachments to these suppliers in line with your choice about whom you want to be seen and the instruction given to us by our relevant employer customer.
- In cases where our employer member customer uses Heetsoft with a “group company” structure consisting of legal entities holding the title of multiple data controllers, your data in Heetsoft membership account can be seen by all group companies that have membership in Heetsoft and with the instruction of the relevant employer. If all group companies instruct their applications to be collected in a single pool, we list the members among these companies during your application and share this data for viewing limited to the relevant group companies, upon your approval. Although this does not mean that our employer companies have fulfilled their obligation to inform, we convey that the resume you have created within Heetsoft may also be accessible by the companies you have blocked.
YOUR RIGHTS
In accordance with Article 11 of the PDPL, regarding your personal data, provided that you prove your identity;
- To learn whether the Company processes personal data about you, and if so, to request information about it,
- To learn the purpose of processing your personal data and whether they are used in accordance with the purpose,
- You have the right to learn whether personal data is transferred domestically or abroad and to whom.
- In addition, you have the right to request the Company to correct your inaccurate and incomplete personal data and to inform the recipients whose data has been or may have been transferred.
You can request the destruction (deletion, destruction or anonymization) of your personal data from the Company within the framework of the conditions stipulated in Article 7 of the KVKK. At the same time, you can request that the third parties to whom we transfer your data be informed about your destruction request. We will evaluate which method is appropriate for your destruction request according to the circumstances of the concrete case.
You may object to the results of your personal data analysis, created exclusively using an automated system, if these results are contrary to your interests.
If you suffer damage due to the unlawful processing of your personal data, you can request the removal of the damage.
We will conclude your requests in your application free of charge within thirty days at the latest, depending on the nature of the request. However, if the transaction requires a separate cost for the Company, we may apply the fee in the tariff determined in the Communiqué on the Procedures and Principles of Application to the Data Controller by the Personal Data Protection Board.
In matters related to the processing of your personal data, you can submit your application by filling out the application form attached to this Clarification Text, in writing, or in writing with a registered e-mail (KEP) address, secure electronic signature, mobile signature or that you have previously informed us and in our records. You must submit it to our Company using your e-mail address. Depending on the nature of your request and your application method, the Company may request additional verifications (such as sending a message to your registered phone, calling) in order to determine whether the application belongs to you and thus protect your rights. For example, if you apply through your e-mail address registered with the Company, we may contact you using another communication method registered with the Company and request confirmation of whether the application belongs to you.
